Overview
Welcome to The Foot Method. “We,” “us,” and “our” refer to The Foot Method, which operates this store and website — all related content, features, tools, products, and services (the “Services”). The Foot Method is powered by Shopify, which enables us to provide the Services to you. By visiting, interacting with, or using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not use the Services.
Access & account
You represent that you are at least the age of majority where you live, or that you have a parent or guardian’s consent. You agree that the information you provide is correct, current, and complete, and that you have the rights necessary to provide it. You are responsible for keeping your account credentials secure and for activity on your account, and you may not transfer or sell your account to anyone else.
Our products
We have made every effort to represent our products accurately, but colors and appearance may differ depending on your device. We do not warrant that a product’s appearance or quality will match what is shown on your screen. Product descriptions may change at any time, and we may discontinue a product or limit quantities at our discretion.
Orders
When you place an order you are making an offer to purchase, which we may accept or decline for any reason; your order is not accepted until we confirm it, and we must receive and process payment first. If we cannot accept, change, or cancel an order, we will try to reach you using the contact details you provided. Your purchases are subject to our return policy (see Shipping & returns), and are for your own personal or household use, not for commercial resale or export.
Prices & billing
Prices, discounts, and promotions may change without notice; the price that applies is the one in effect when you place the order, as shown in your confirmation email. Unless stated otherwise, posted prices exclude taxes, shipping, handling, and customs charges. You agree to provide current, complete, and accurate payment and account information, to keep it updated, and that you are authorized to use the payment method you provide.
Shipping & delivery
We are not liable for shipping or delivery delays. All delivery times are estimates only and are not guaranteed, and we are not responsible for delays caused by shipping carriers, customs processing, or other events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you. (Shipping rates and timeframes are on the Shipping & returns page.)
Returns & refunds
We offer a 30-day satisfaction guarantee. If you are not satisfied for any reason, return your product within 30 days of delivery for a full refund. We accept returns on used, opened, and modified products — you do not need to return them in original condition. We trust you.
To start a return, email hello@footmethod.com with your order number. Full details are on the Shipping & returns page, which is the authoritative return policy and governs if anything here differs.
Reviews, photos & other feedback
If you submit a review, photos, or any other ideas, suggestions, or feedback (“Feedback”), you grant The Foot Method a perpetual, worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt (for example, to edit for length), publish, distribute, and display that content in connection with the store and our marketing. You keep ownership of what you submit.
You represent that the review is your own honest experience; that you own or have permission to share any photos and that they do not infringe anyone else’s rights or privacy; and that you have disclosed any compensation or incentive you received for the Feedback. You will not impersonate anyone or misrepresent the origin of your Feedback.
We are not obligated to keep Feedback confidential, to pay for it, or to respond to it. Reviews are moderated before they appear, and we may decline, edit for length, or remove content we consider unlawful, objectionable, or in breach of these terms. Published reviews show your first name and last initial and your photos; we remove embedded photo metadata (including location data) before storing them, and we never publish your email address.
Not medical advice
Our products, the “Find Your Method” quiz, and our educational content are for general wellness and education. They are not medical advice or a diagnosis, and they are not a substitute for care from a qualified clinician. The quiz is a triage tool that matches your answers to a likely pattern — only a clinician can diagnose you. If your pain is severe, sudden, or not improving, please seek professional care.
Intellectual property
The Services — including our trademarks, brand, text, displays, images, graphics, video, audio, and the selection, arrangement, and presentation of content (including how reviews are compiled and displayed) — are owned by The Foot Method, its affiliates, or licensors and are protected by intellectual-property laws. Individual reviews and photos you submit are governed by the “Reviews, photos & other feedback” section above, not this one. These terms permit personal, non-commercial use only; you may not reproduce, distribute, modify, or republish our materials without our prior written consent. The Foot Method’s names and logos are our trademarks; Shopify’s are Shopify’s; other marks belong to their owners.
Optional tools
We may give you access to third-party tools that we neither monitor nor control. You use them “as is” and at your own risk, and you should review the relevant third party’s terms. We have no liability arising from your use of optional third-party tools. New features we add to the Services are also subject to these terms.
Third-party links
The Services may link to websites operated by third parties. We are not responsible for examining or evaluating their content, and we are not liable for any harm related to third-party sites or your purchases from them. Please review their policies before transacting with them, and direct any concerns about their products or services to the third party.
Relationship with Shopify
The Foot Method is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with The Foot Method. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and The Foot Method, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with The Foot Method.
Privacy
Personal information we collect through the Services is subject to our Privacy Policy, and certain information may be subject to Shopify’s privacy policy. Because the Services are hosted by Shopify, information you submit is transmitted to and shared with Shopify and third parties that may be located in other countries, in order to provide the Services to you.
Errors, inaccuracies & omissions
Occasionally there may be typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct any such errors and change or update information, or cancel orders, at any time without prior notice (including after you submit an order).
Prohibited uses
You may use the Services only for lawful purposes. You agree not to use them for any unlawful or malicious purpose; to violate any laws; to infringe anyone’s intellectual-property rights; to harass, abuse, or harm others; to transmit false or misleading information or spam; to impersonate anyone; to upload viruses or malicious code; to collect others’ personal information; to scrape, copy, or resell any part of the Services; or to interfere with or circumvent the security or access-control features we use. We may suspend or terminate your access if you violate these terms.
Automated agents
These Agent Terms apply if you use, enable, or cause an Agent to access or interact with the Services. An “Agent” is software or a service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity, and that can run without direct supervision.
An Agent may not access or interact with the Services unless it identifies itself and operates in accordance with the requirements below at all times, and not at all if we have asked it to refrain. We may limit, including by technical measures, whether and how any Agent accesses the Services.
Agents must:
- identify, in all HTTP/HTTPS requests, that the request is from an Agent and disclose its name in the request’s user-agent string in the form “Agent/[agent name]”;
- not conceal or obfuscate that activity is from an Agent — including by mimicking human behavior, or completing or circumventing CAPTCHAs or other measures meant to distinguish computers from humans;
- respond truthfully to any prompt seeking to determine whether interactions come from a human or a computer; and
- not circumvent or avoid any measure intended to block, limit, or control how Agents access the Services.
Termination
We may terminate this agreement or your access to the Services at any time, in our sole discretion and without notice, and you remain liable for amounts due up to termination. Sections that by their nature should survive termination — including Intellectual Property, the Feedback license, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver / Entire Agreement, Assignment, and Governing Law — will continue to apply.
Disclaimer of warranties
The information on the Services is provided for general information only and we do not warrant its accuracy, completeness, or usefulness; any reliance on it is at your own risk. EXCEPT AS EXPRESSLY STATED BY THE FOOT METHOD, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU. (This “as is” disclaimer does not displace our 30-day satisfaction guarantee described above.)
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE FOOT METHOD AND ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS — AND THOSE OF SHOPIFY AND ITS AFFILIATES — WILL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS) ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.
Indemnification
You agree to indemnify and hold harmless The Foot Method, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims (including reasonable attorneys’ fees) arising out of your breach of these terms, your violation of any law or the rights of a third party, or your use of the Services. We may control the defense of any such claim at your expense and will not settle a claim imposing non-monetary obligations on you without your consent (not to be unreasonably withheld); you agree to cooperate in the defense.
Severability
If any provision of these terms is found unlawful or unenforceable, it will be enforced to the fullest extent permitted, and the unenforceable portion will be severed without affecting the remaining provisions.
Waiver & entire agreement
Our failure to enforce any right or provision is not a waiver of it. These terms, together with any policies we post, are the entire agreement between you and us regarding the Services and supersede any prior agreements. Ambiguities will not be construed against the drafting party.
Assignment
You may not assign or transfer these terms or your rights and obligations under them without our prior written consent, and any such attempt is void. We may assign or transfer ours without notice to you.
Governing law
These terms are governed by, and construed in accordance with, the laws of the State of California, United States, without regard to its conflict-of-laws rules. You and The Foot Method consent to the exclusive venue and personal jurisdiction of the state and federal courts located in California.
Changes to these terms
You can review the most current version of these terms on this page. We may update or replace any part of them by posting changes here; it is your responsibility to check periodically. We will notify you of material changes as required by law, and your continued use of the Services after changes are posted constitutes acceptance of them.
